Welcome to TalentHub! By accessing or using our website, mobile applications, and services (collectively, the "Platform"), you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree, please do not use the Platform.

1. Acceptance of Terms

By creating an account, browsing jobs, posting a position, or otherwise using TalentHub, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms applicable to specific features. We may update these Terms from time to time; your continued use constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 16 years old to use the Platform. If you are accepting these Terms on behalf of a company or organization, you represent that you have authority to bind that entity. The Platform is not available to users whose accounts have been suspended or terminated.

3. Account Registration

To access certain features (e.g., applying to jobs, posting jobs), you must create an account. You agree to provide accurate, current, and complete information and to keep your login credentials confidential. You are responsible for all activities under your account. Notify us immediately of any unauthorized use.

4. Use of the Platform

4.1 For Job Seekers

You may use TalentHub to search for job opportunities, submit applications, and communicate with employers. You represent that all information in your profile and applications is truthful and not misleading.

4.2 For Employers

You may post job openings, search for candidates, and contact applicants. You agree that your job postings will comply with all applicable laws and will not contain discriminatory, fraudulent, or misleading content. TalentHub reserves the right to remove any job posting that violates these Terms.

5. Prohibited Activities

You agree not to:

• Use the Platform for any unlawful purpose or to violate any rights of others.
• Post false, inaccurate, or deceptive content (including fake job listings or applications).
• Impersonate any person or entity.
• Upload viruses, malware, or any code that may disrupt the Platform.
• Scrape, copy, or automate access to any part of the Platform without our written permission.
• Harass, abuse, or harm other users.

6. Intellectual Property

TalentHub owns all rights, title, and interest in the Platform, including its design, software, trademarks, and content (excluding user-provided content). You may not copy, modify, distribute, or create derivative works based on our Platform without express permission.

By posting content (e.g., job listings, profile information), you grant TalentHub a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content on the Platform and to promote it through our channels. You retain ownership of your content.

7. Communications

By creating an account, you agree to receive electronic communications from us (e.g., emails, notifications) related to your account, applications, and platform updates. You can opt out of marketing emails but will still receive transactional messages.

8. Fees and Payments

Posting jobs may involve fees. All fees are clearly displayed at the time of purchase. Payments are processed by third-party providers. Fees are non-refundable except as required by law or as specified in a separate agreement.

9. Third-Party Links

The Platform may contain links to third-party websites (e.g., employer sites). We are not responsible for their content or practices. Your use of third-party sites is at your own risk.

10. Disclaimers

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. TalentHub disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Platform will be error-free, secure, or uninterrupted, or that any jobs or applications will lead to employment.

11. Limitation of Liability

To the fullest extent permitted by law, TalentHub and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. Our total liability shall not exceed the amount you paid us (if any) in the past six months.

12. Indemnification

You agree to indemnify and hold harmless TalentHub from any claims, losses, liabilities, and expenses (including legal fees) arising out of your violation of these Terms, your misuse of the Platform, or your infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and without prior notice. You may delete your account at any time via your settings. Upon termination, certain provisions of these Terms (such as intellectual property, disclaimers, and limitation of liability) will survive.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any disputes arising out of these Terms shall be resolved exclusively in the state or federal courts located in San Francisco County, California.
